If you are planning to sell a home in Massachusetts, the new home inspection law has changed how inspections fit into the process. It sounds dramatic, but in reality it is far less intimidating than many sellers fear.

Under the new law, buyers cannot be required to waive their right to a home inspection. Sellers also cannot accept an offer if a buyer has already stated that they intend to waive that right. This change was designed to create a more transparent process, especially in competitive markets like Boston and the North Shore.

Both buyers and sellers now sign a disclosure acknowledging the buyer’s right to a home inspection. This does not mean something is wrong with your home and it does not create new repair obligations. It simply confirms that everyone understands the rules and that inspections are part of the transaction.

Here is the part sellers should take a deep breath about. This law is not a deal killer.

In Boston and on the North Shore, many homes are older and inspections have always been part of the process. What this law really does is shine a brighter light on preparation. Sellers who plan ahead, price with condition in mind, and think through potential inspection concerns tend to have smoother transactions and far fewer surprises once under agreement.

With the right strategy and guidance, inspections remain a manageable and very predictable part of selling your home.
